Supreme Court and the death penalty

The supreme court will soon be deciding whether lethal injection violates the constitutional ban on 'cruel and unusual' punishment. This also as it agrees to consider whether convicts can be put to death for non-capital crimes, such as child rape.

I think the death penalty in any shape or form for any crime constitutes cruel and unusual punishment. Even if it rules against the current 3 drug injection system, states will just find another method, such as lethal injection of massive amounts of barbiturates, like how we put animals to sleep. Innocent people are convicted of murder, and are put on death row for it. Many people are falsely accused or convicted of rape, and we are now considering whether to execute these people too.
